From the Brink to Victory: Bochetto & Lentz Secures Major Verdict and Receivership for Philadelphia Condo Association

In a case that underscores the importance of aggressive, strategic litigation, Bochetto & Lentz has secured a landmark victory for the residents of the Lofts at 1234 Hamilton. Following a rigorous five-day trial before the Honorable Anne Marie Coyle in the Philadelphia Court of Common Pleas, the court returned a verdict in favor of our clients, resolving a complex dispute rooted in the Pennsylvania Uniform Condominium Act.

The case, Volla et al. v. Lofts at 1234 Condominium Association, began under incredibly difficult circumstances. When Bochetto & Lentz was first retained, the Plaintiffs, two dissident unit owners, had already obtained a default judgment against the Association. The Association hadn’t even had the opportunity to respond.

The Challenge: A Culture of Litigation

The Plaintiffs, both former board members, had engaged in a long-standing pattern of behavior that paralyzed the Association’s governance. By suing five of the last five board members individually, they created an environment of fear where no other residents were willing to serve. The situation escalated to a fiduciary crisis when the Association’s insurers required the Plaintiffs to be listed as “specific exclusions” on insurance policies due to their history of meritless litigation.

The Strategy: A Powerhouse Counter-Strike

Bochetto & Lentz didn’t just defend the case; we changed the narrative. After successfully opening the default judgment, Ryan T. Kirk filed a counterclaim on behalf of the majority of unit owners seeking receivership to stabilize the building’s future.

The trial involved testimony from six residents and the review of tens of thousands of pages of documentary evidence. We successfully demonstrated that the Plaintiffs had engaged in what the Court described as a “long-term and well-patterned bullying effort” designed to unfairly control the property and diminish the rights of their neighbors.

The Result: Relief

The Court’s verdict provides the Lofts at 1234 Hamilton with the “clean slate” they desperately needed:

  • Receivership Granted: The Court appointed a receiver to restore order, with the majority of costs to be paid by the Plaintiffs.
  • Board Ban: The Plaintiffs are barred from board service for a decade.
  • Litigation Sanctions: The Plaintiffs are forbidden from filing new lawsuits without prior Court approval.
  • Financial Recovery: The Court ordered the Plaintiffs to pay Bochetto & Lentz’s attorney’s fees and monetary compensation to affected residents.
